1. Applicability

These Terms and Conditions of Use are applicable to all business relations between BCE AG and their customers at the time of the conclusion of contract. Any dissenting conditions contrary to our Terms and Conditions will not be recognized, except if those particular cases have been explicitly agreed to in writing by BCE AG.

2. Registration

Any order placed in the BCE AG online shop requires a prior registration as a customer of the BCE AG online shop. A multiple registration using various names or addresses isn't permitted. Only once the registration of a customer to our BCE AG online shop has been completed successfully, can he/her access our online shop.

3. Prices

The currency used in the contract and for invoicing is the Swiss franc (CHF). All prices are fixed prices, including VAT. Only our resellers with commercial register entries are excluded from this policy. The terms of payment are as follow: cash on delivery, cash with order (payment by credit card) and bank transfer to our account Swiss Postal account number 30-367702-3 (Yellowpay by post.ch). We accept credit cards for foreign deliveries, although payments are effected in Swiss francs. The shipping costs indicated are only valid for Switzerland. All exporting costs, such as customs duty, VAT, bank or postal expenses are carried by the customer/recipient. We reserve the right to modify prices, especially if the currency is subject to fluctuations and if there is a shortage of supply on the part of our supplier.

4. Minimum order value

Since June 2016 there is no minimal order value anymore.

5. Delivery

Deliveries are solely effected by payment in advance and at the recipient's expense and risk. Without explicit agreement deliveries of football tables are effected franco domicile (free curbside delivery) and are delivered unassembled. The cost of the packaging for bulky items (like football tables) is carried by the customer. To revoke an order the customer must bear a CH 40.- fee. A possible revocation of your order must be previously agreed with us during the purchasing. Provided there are no delays in supply on the part of our supplier and no shortage of stock, postal deliveries are shipped within 2 workdays from the reception of your order. The goods have been controlled and are well packed. The customer is responsible for providing the correct address of delivery. The information given regarding the estimated time of delivery is without engagement.

Please contact us to receive a special offer for large quantities.

7. Sending samples

Samples can only be sent to well-known purchasers and exclude football and billiard tables as well as cues. The return date stated on the postmark must be observed. In case of any delay in the returning of the samples a CHF 50.- fee will be charged to the potential purchaser. Packaging and shipping expenses are carried by the purchaser. Damaged or used goods will be invoiced to the purchaser.

8. Exchange and returns

Naturally you can exchange or return goods. You can exchange the goods within 5 workdays provided they haven't been used or damaged (this includes damages caused by postal transportation) and have remained in the original packaging. The packaging and shipping expenses are carried by the customer. Reimbursement is always in form of credit vouchers.

9. Notice of defects

In case of obvious damages to the goods due to transportation the customer must immediately declare these damages to BCE AG and note them on the bill of lading. If the packaging of bulky goods such as tables is visibly damaged, please note them on the dispatching order, otherwise no claim for compensation will be considered. All deliveries are insured against damage during transportation.

10. Payment

Payment in advance by credit card (Visa/Mastercard) or by transfer from your Swiss Post Finance Account (Yellowpay from post.ch) in Swiss francs. In case of payment delays, benefits such as discounts or free deliveries are cancelled. Customers also have the opportunity to pay by invoice (private customers: max. CHF 300; business customers: max. CHF 2'000).

11. Interest for delay

If the payment deadline is exceeded, an 8% interest for delay will be charged 11 days after the date of invoice as well as CHF 20.- per reminder.

12. Reservation of property rights

The goods delivered remain the property of the seller until payment has been received in full.
In case of payment delay, we expressly reserve the right to withdraw from the contract. We reserve the right, even after conclusion of contract, to conduct a credit assessment and if necessary to withdraw from the contract. In case a supplier cannot provide the goods ordered, thus impeding us to insure their delivery, we reserve the right to withdraw from the contract. In case of withdrawal, we will inform our customers of the unavailability of the goods and reimburse the payments already made.

13. Data privacy

Our customer's data will be saved and if necessary forwarded to a third party under strict observation of applicable regulations and only for business purposes such as processing the order. Any personal information will remain strictly confidential. We reserve the right to forward personal information to allied companies in case of a credit assessment. Furthermore, we reserve the right to inform you of BCE AG's special offers. Customers of the BCE AG online shop can consult and modify their user information at any time within the protected area of the online shop.

14. General information

  • We are not liable for mistakes or typing errors.
  • Despite of carefully controlling the content, we are not liable for the content of external links. The content of the pages linked is the responsibility of their owner.

15. Applicable law and place of jurisdiction

The regulations of the Swiss law apply, even in case of a foreign order or a foreign delivery. The place of jurisdiction in case of a claim regarding your order, even if ordered abroad, is Bern. We reserve the right to file a suit in your place of jurisdiction. The ineffectiveness of certain regulations will not affect the effectiveness of the contract or these terms and conditions of use.
